BAKKASSI DISPLACEMENT CHALLENGE


As part of constituency responsibility Hon. Victor Abang's motion of:
"Threat of Invasion of Okwa Community, Boki Local Government Area by the Cameroon” jolted patriotic Nigerians that the border issue is still volatile after the legal and diplomatic ruse.

The Green Tree Agreement which is the outcome of the ruse came to the effect that Nigeria ceded sovereignty of Bakkassi to Cameroon.

Since then the fate of Nigerians displaced from Bakkassi LGA after the International Court of Justice (ICJ) ruling became a complex and challenging journey. The events unfolded after the ICJ's decision on October 2002, which awarded the Bakkassi Peninsula to Cameroon.

As a result of the ruling, thousands of Nigerians who  had been living in Bakkassi were displaced from their homes. The region had a rich cultural heritage and the displacement brought about significant social, and emotional upheaval for the affected communities.

It was Senator Florence Ita-Giwa's constituency and she confronted the responsibility and struggle to the point where she was nicknamed "Mama Bakkassi".

The Nigerian government, in collaboration with organizations and agencies, initiated a resettlement plan to address the needs of the displaced population. Temporary shelters were set up to provide immediate relief, including food, water, and medical assistance, However, the long-term prospects for those affected remained uncertain.

The displaced Nigerians faced various challenges as they adjust to life in new locations. Many struggled to find suitable employment and loss of their traditional fishing grounds further exacerbated the their economic difficulties. The cultural ties to the Bakkassi Peninsula were strong and the forced relocation disrupted the social fabrics of these communities.

In response to the difficulties faced by the displaced Nigerian government continued to work with international partners to implement development projects aimed at improving living conditions in the resettlement areas. Efforts were made to provide education, healthcare, and infrastructure to support the affected communities.

Over time, some semblance of normalcy returned to the lives of the displaced Nigerians, but the scars of displacement an the loss of their ancestral land lingered. The story of the Bakkassi Peninsula serves as a reminder of the complexities surrounding territorial disputes and the human cost of geopolitical decisions made at the international level. The hope for those affected was that, with time, their resilience and the support of the government and international collaboration would metamorphose their lives in the communities.

Perhaps the most pertinent question to ask is whether deployment of Nigerian troops at the border is a temporary measure or panacea?

THE DWINDLING RELEVANCE OF FOSSILS AND OIL IN DRIVING DIGITAL ECONOMY


As the 2023 Climate Change Summit COP28 Dubai, rose with a 'historic' agreement to do away with fossil fuels in order to facilitate global net zero emissions by 2050, the Financial Times of London described the development as "Imperfect progress". This came on the heels of Africa's largest refinery, Dangote taking it's maiden delivery of crude oil to commence production early next year. 

The atmosphere was filled with energy concerns and the relevance of various sources of energy towards clean energy and the digital economy. It was pertinent also to reminisce that locomotive engines derived energy from coal and fossils until oil was discovered. It was for this reason that oil dominated the 20th century economy.

The 20th century stands as a pivotal era in human history, marked by unprecedented technological advancements, economic transformations, and geopolitical shifts. One of the most influential factors that shaped the trajectory of the global economy during this period was the discovery, extraction, and utilization of oil. Often referred to as the "black gold," oil emerged as the lifeblood of industrialization, powering economies, fostering technological innovations, and significantly impacting geopolitics.

The Rise of the Oil Industry:

The 20th century witnessed the rapid rise of the oil industry, with its epicenter in the Middle East, North America, and other oil-rich regions. The commercial exploitation of oil began in earnest in the late 19th century, but it was the 20th century that saw its meteoric ascent to prominence. Pioneering figures like John D. WHO'S A DUE PROCESS AND COMPLIANCE OFFICER?

I came across vaccancy posts for "Due Process and Compliance Officer' several times in the past but never considered who the prospective employers are searching for.

When I felt concerned to finout who are qualified I was startled by my findings.

I'm coming from a legal background with some trainings and experiences. With that mindset I was expecting lofty academic and corporate status qualifications.

Would it shock you to know that there's no particular qualificatons attached to that vaccancy?

One of the prospective employers simply wanted someone who can ensure that the  company complies
 with government  requirements and other external regullatory agencies.


For instance a person who has considerable amount of information about Nigerian Ports Authority by virtue of previous employments or services may be considered for that vaccancy in  Import/Export company.

Another example could be someone who had considerable experiences with electricity generating company could be considered for that vaccancy in a company like EEDC, KEDC etc 

The Nigerian Data Protection Act which just t came into effect made provision for Data Protection Officer (DPO)… For the qualifications of a DPO one would have thought that formal academic or specific skills were necessary, but the Act holds a contrary view. Just departmental knowledge and experience are enough to land you the job.

But hey, don't walk away with that simple definition hook, line and sinker.  

Some vaccancies demand specific skills like having engineering, medical, baking and finance degree.  In some cases you're required to be experienced and analytical.

Don't forget that some employers use different names for the post; like Enforcement Officer. So whenever you see those vaccancies don't consider yourself out until you've gone through properly.

The more challenges in our environments, the more elastic our potentials to achieve more.

Therefore to avoid feeling of despondency and redundancy after attaining the peak of performance, find more/higher pitches and challenges.

Just one scenario that links everyone is the issue of shelter. According to Abraham Maslow on hierarchy of needs, shelter is second most important thing in life.

If you don't have it and you don't mind, you're probably considered to be of unsound mind.

If you have, it must have cost you significant part of your income - about 40% of our incomes or a little less.

Even if it's a gift the value can only be appreciated when the property is evaluated for its current worth.

Then for you who's not fortunate to own shelter or gift you occupy one through a contract called Tenancy.  

This is the commonest form of legally occupying shelter owned by a landlord.

It's a periodic contract for specified fee and conditions. The tenant's rights don't last for ever. 

Occupation is not guaranteed; the tenant remains as long as fees and conditions are regular. Not forgetting that the landlord always reserves an overriding clause to recover the property from the tenant's possession even when fees and conditions are regular. 

Take casestudy of two tenants A and B who occupied identical apartments for 25 years of their working lives, or doing business, paying exact yearly rents of N200,000.  

Say they were tenants at Blue Estates, Cityland.. 

Don't panic, we know you don't live at Blue Estates Cityland. You could live anywhere, working or independent business.

Tenant A stayed in the apartment for 25 years, retired and remained a tenant.

Even God wishes you prosper and remain in good health. You need knowledge to achieve that. 

Tenant B took our Report option in the Tenancy Agreement that allows any tenant wishing to become owner occupier, to pay purchase value of the property.

We hear you say 'where I go find money?" You need valuable knowledge and it's application to achieve that.

Any cost to acquire the knowledge is investment in success.

We can assist you find opportunities money can be accessed at some costs. But if you consider yourself Tenant A, then that's the end of the benefits for you as far as our Report is concerned. 

But your loved ones, well-wishers and contacts may benefit from our Report/project.

The reason is that as you retire after 25 years as tenant at Blue Estates, you'd continue to remain in the apartment as tenant, provided your rents and conditions are regular. 

Perhaps the more devastating thing is, you can't own the property.

While we were analysing Tenant A's consequences of his choice decion, we should have told you that Tenant B who took our advice/option retired and lived in the apartment as owner occupier. No stories.

Here's a tip. These days there're crowd-funding schemes organized by groups, Start-ups and cooperatives.

Access to any of them would have saved you the ordeal of seeking for overdraft, or short-term loan from your bank or any other formal lending institution.

We don't discourage any legitimate means you may resort to for effectively activating your mortgage project, however we're aware that provision of collateral to secure any financial deal is real challenge.

REGULATING AI: A GLOBAL CHALLENGE

Since artificial intelligence (AI) became commonplace and applied by anyone

 according to need an affordability, the entire world is not only aware but engaged in serious dialogue about how to respond to it.

European Union (EU) Act is the first global effort at regulating artificial intelligence (AI) aside from measures being taken by other sovereign states and political regions.

Apart from being strict, the emphasis of the Act is on the adoption of  AI as a safe and environmentally friendly innovation.

More other concerns of the Act include transparency, non-discrimination and traceability.  Most importantly the Act insists that the entire AI system should be under human supervision instead of AI. 

That sounds reassuring to assuage the fear of possibile endangering human lives and existence by AI.

Other jurisdictions like USA and North America, opted for lessez-ferez approach; abhorring any form of legislative regulations.  Instead the existing intellectual property rights: copyright, patent, trademark etc remain sacrosanct.  

Whereas the judiciary are strengthened to uphold and protect these rights against any invasion or infringement by AI innovations.

Asian regions, especially China and India introduced strong regulations but they seem to be concerned about the control of AI within their sovereign enclaves.

The approach adopted by South American countries differ significantly from those dealt with already in this discourse.  

Rather than embracing EU legislative approach or relying on the judicial powers like USA, they're using corporate governance as guide or minimum standard: the general rules and exceptions. 

Some Latin America countries put in place measures to protect minorities from the effect of AI, and collectively punish breaches. Perhaps big entities and individuals are left to confront AI application where their rights are threatened.

African continent appear to be sizing up the latent adverse effects of AI, even though a large proportion of the continent have embraced the use and confidence is growing by the day.

It's not unlikely that when they're ready many of them may adopt legislative approach. Most of them have written constitutions as well as written IP laws.

Overall, the world is aware and awake to the presence of AI. Massive education, collaboration and global corporate governance are needed to harmonize use of AI and regulate it's use.

Artificial Intelligence AI is the trending

 technological innovation that has been

received with  mixed feelings,  worries,

fears, anxiety and apprehension are just

 few ways  to describe how people respond

 to AI.

 

Emotion is at the centre of it; whether it’s

 based on loss of control, uncertainties,  

values, jobs or privacy concerns.

 

Are you scarred that AI is becoming the

 21st century digital giant that’s becoming

difficult to tame? Well you’re not alone. 

Few clues as to where we’re in the radar, if

AI is a technological innovation that was

 created by human intelligence which

 could become disastrous because of

individuals or groups can stop the

crescendo of AI trajectory.

 

Here’s why.  A recent survey conducted by

concerned experts revealed among other

things that more than 80% of all

respondents agree that for researches and

routine tasks AI is safe.

 

The second finding of the survey is that

62% of respondents believe that effective

use of generative AI will separate

successful law firms from unsuccessful

firms within the next xt five year

 

Put all these together and think of how to

 navigate, for numerous people I bet

nothing can be more intimidating and

monumental. 

 

And the most critical aspect?

Where to start.

WELCOME ALL SUSCRIBERS I had written my maiden newsletter, and just as I was concluding I came across a quote by American Industrialist Harvey Firestone that “the growth and development of people is our highest calling of leadership”.          That quickly reminded me about the mantra of this newsletter which is “Intellectually endowed legal ideas, developments and innovations no professional would like to miss”.          Being the maiden edition I immediately changed to “Corporate Social Responsibility” (CSR): a global business phenomenon, that touches every aspect of human endeavours. More of that in the near future.        1. Suffice to say that content could Attract or Repel. It could also reflect or  address the mood of your audience. 2.  When a content doesn't fit, save it for future engagement or edition.  I'm humbled to announce that your decision to subscribe is not a blind one. ANOTHER EDUCATION JAUNDICE LOOMING

As schools are reopening nationwide, there seem to be another education 'jaundice' looming. 

Students of some tertiary institutions are already protesting the hike in school fees that came with the new administration.

Since the focus is on education, it's pertinent to remind ourselves that the removal of fuel subsidy was the straw that broke the camel's back.

If not ASSU, it's  students' strike or government's closure of schools on flimsy excuses other than COVID or epidemic.

The negative outcomes like Shakespeare would say live with the society.🎎

Government is a public office. Those who occupy it today are merely attempting to solve similar problems left over by their predecessors.

The significance of education on human capital development and the entire world cannot be over-emphasized.✍️

At the just ended United Nations General Assembly (UNGA77) the President of World Bank group hit the nail on the head when he aptly observed:

"A silent learning crisis is unfolding that has become devastating shock to human capital.  We need to work to prevent further damage and build more effective systems. We urge you the world leaders, to meet this crisis head-on and act to improve learning outcomes for all children everywhere"

With the situation right now in Nigeria  only to the students and their sponsors are on the receiving end, with federal government declaring surpluses.👏

When the erstwhiile Rivers State governor Nyesom Wike was appointed Minister for FCT he warned an appealed to those who are aware of ABUJA master plan, violated it and went ahead to put structures on them should vaccate, relocate or face demolitions.

The law is a social engineer. It's a sword and shield simultaneously.  One of the ways to step on toes, powerful toes, is firm  stand on instant laws without compromise.
 
Now the structure on Plot 226, Cadastral Zone A02 Wuse 1, Wuse, Zone 6 District, is said to belong to Oba Oyebade Lipede, the Alake of Egba land, but was allegedly taken over by one Alhaji Ibrahim Mohammed Kamba and Alhaji Ademu Teku unlawfully was demolished days ago.

It's baffling when enlightened elements resort to threats in challenging situations like frustration of contracts which could have demanded mitigation.

According to the avowed approach of the Minister, there's certainly no value in crying when the head is off.

With the support of the constitution, your rights are our concerns, however it's your duty to protect them.

Dr Vwaere Diaso who studied medicine and obtained her

degree from Babcock University, was reportedly dead in

 the elevator accident that occurred in a Lagos general

 hospital where she had only two weeks left for the

 completion of her housemanship.

It's not enough to console her family, colleagues, state

 and the nation for the loss. It could anyone of us across

 the globe.

NUMBER OF COLLAPSED BUILDINGS ...

According reports a total of 61 incidents of collapsed

building occurred in Nigeria in 2022.


Meanwhile there's in existence National Building Code,

and Building Code Advisory Committee, established more

than a decade ago.

"The Committee” is hereby established, and shall be

answerable administratively and operationally to the

Minister. It shall be the duty of the Minister to brief the

 National Council on Housing and Urban Development on

activities of the Committee.


If the provisions of the National Building Code are

observed to the letter why do we have rampant incidence

of building collapses and defective constructions leading

to accidents? Apart from security threats, loss of lives

and properties arising from these avoidable incidents it 

as raised questions about the efficiency and capability of 

professionals and government agencies responsible for

 enforcing the provisions of the relevant laws.

There seem to be lapses along the line of all agencies

 responsible for enforcement. We have to start from

creating awareness of the law sine Nigeria is largely rural

 in construction compared to advanced countries. The

 awareness is also necessary for those who apply and

 enforce the laws.  For instance those who issue

 approvals for buildings and constructions going on in the

 communities should be held responsible in tort.

PROFESSIONAL OBLIGATIONS

Many professionals are involved in the building and

 construction industry and it would be unfair to single out

 one professional for blame.  However, it amounts to

 criminal silence on the part of Quantity Surveyors and

 Construction and Cost Management professionals not to

 whistle-blow or report when buildings are being set up

 without proper compliance with relevant laws,

 specifications and approvals leading to their collapses.

GOOD CORPORATE GOVERNANCE & CORRUPTION ARE NOT COMPATIBLES 

The government and corporate bodies have the

 responsibility to curb corrupt practices for good

 corporate governance to excel.  Corruption thrives

 because of three main conditions that are constantly

 preserved:

1 Benefits acquired illicitly

2 Low-risk of penalty/prevention

3 Disregard of morality: pain of poverty/privilege of public

 office

To tackle it advanced countries have heightened the scale

 of penalty, sense of morality and detection of crime.  It

 seems that the focus in Asia  has been to heighten sense

 of morality only. In spite of all these Halliburton, FIFA,

 ENRON etc are still fresh case studies which raise the

 issue of sanctions and its efficacy.

The various governments connected to late Vwaere

 should go for Inquest and  probably corporate

 manslaughter.

THE NEW THREAD DEBUT

New thread app @ is an equivalent of Twitter produced by Meta. It's just rivals Twitter in SMS service companies.

Since Wednesday when it debutted it garnered over 10 m subscribers, according to repors. This seems to be indication of success and acceptance by the market.

However, it seems to be coming in phases. At this time, it seem only some countries will be able to access the app.

It's also apparent that not all devices would access the app.

The app operates with existing Instagram accounts and Facebook. Untill you download the app don't give thumb up/down for the app. From the grapevine President Ahmed Tinubu has joined the bandwagon of the early subscribers.

Whatch out for developments.

HIGH EXPECTATIONS FROM THE LEADERSHIP

Section 50(1) of the 1999 Constitution of the Federal Republic of Nigeria as amended prescribe: “There shall be: (a) a President and a Deputy President of the Senate, who shall be elected by the members of that House from among themselves”

Nominations must consider the rankings of the senators. Certainly the longer and experience their services the more attractive and likely to be nominated.

It's therefore not surprising that  Orji Uzor Kalu, South East Godswill Akpabio South-South, were  among the leading contenders for the position. Finally, Akpabio won.

As Akpabio becomes President of the 10th Senate expectations are high about his leadership style and priorities on burning issues of the moment.

His eligibility was obvious and was almost taken for granted, having been previously elected to the Red chambers and served as minority leader.

Before that he had served at various leadership positions. He'd be bringing the leadership skills of former student leader, councilor, chairman, governor, and Minister for Nigeria Delta.

In his acceptance speech, he left no one in doubt that about his inclusive leadership style. His loyalty to the President was equally made known.

Some of the burning issues Akpabio-led National Assembly urgently have to tackle through legislation include security, EFCC, economy etc. He acknowledged that the economy requires 'renewal and revitalization'.

He needs to assure Nigerians that he would not repeat the negative version of the erstlwhile  Ahmad Lawan-led 9th senate.

Having yearned for good and development-oriented leadership since the return of civil rule in 1999, Nigerians have high leadership expectations from the 10th National Assembly.

FUEL CRISIS: WHICH WAY NIGERIA?

On the one hand Nigeria's energy policy requires government to ensure access to energy and it's supply, on the other hand it calls govt to use energy to develop the economy.  See National Energy Requirements Responsibility Act.

The compliance guidelines on Petroleum Industry Act 2021 reveal new legal and governance changes in oil and gas industry, such that makes it difficult for decisions to be taken without consultation with stakeholders.

Yet government is expected to implement the provisions of the Act so as to transform the industry and enable complete deregulated upstream and downstream sectors.

NNPC NEW Private Company was  unveiled on 19th July, 2022 by PMB, amidst incomniums poured on the expectations of the 'new company '. One such expectation is deregularizatioin.

Therefore when the President declared 'fuel subsidy gone', it was in the direction of deregularizatioin.  Hoarding and price hikes had sent pandamonium across the country.  Consequently NLC had to declare nationwide strike to protest the fuel hike.

Like economists would say buyers and sellers commenced the new regime with abnormal profits which is only ephemeral.

The next level would be supply of fuel from any available source provided it makes economic sense. Then in the interim with abundant supply the abnormal profits would disappeared. Normal and stable price would be established by the price system..

The damage (both political and economic) would have been done before sanity returns.

Today is national inauguration day across Nigeria. It's a day electorates, politicians and indeed citizens drop their guntlets till the next four years; in hope or despair.
